Facts:­ 
 

 1. The   applicant   Shri   Shyam   Sunder   sought   information   from   the   CPIO, 
IRDA, New Delhi regarding mandatory training prescribed by them after every 3 
years for agents who were appointed after 2000 through 5 points.

2. Not   receiving   a   response   from   the   CPIO,   the   applicant   moved   the 
Commission by preferring complaint. The matter was heard today. Complainant 
did not appear. Respondent was heard through audio conferencing.

3. Respondent stated that they had received the RTI request and prepared a 
draft   reply   on   14   July   2009   which   was   inadvertently   filed   instead   of   being 
dispatched. Respondent has expressed regret for the same and explain that the 
authority has set up a centralized and exclusive RTI Department which will keep 
track of all applications sent to the different CPIO’s in the authority to ensure full 
compliance of the provisions of the Act.   Respondent stated that detailed point 
wise response had been sent to the complainant vide their letter of 2 November 
2010.

Decision

4. Commission   accepts   the   averments   of   the   respondent   and   drops   the 
proposed  penalty  proceedings   in  view  of   the  action  taken  by  the  Authority   to 
strengthen the implementation of the RTI regime in the organization. 

5. Commission   draws  the  attention   of   the  IRDA   to   the   provisions   of   sub 
sections   (1),   (2)   and   (3)   of   section   5   of   the   RTI   Act   with   reference   to   the 
designations and the corresponding duties assigned to the officers of the IRDA in 
respect   of   the   implementation   of   the   RTI   Act   and   ensure   that   appropriate 
designations are given so as to avoid confusion.
