Information sought:
      Detailed information about the action taken on the Silver Jubilee Award Application of appellant
      regarding which Official noting sheet copy, grounds for rejection, and list with name designation
      of the non recipients of this award despite completion of 25 yrs of service and grounds for that was
      sought as information.

Reply of PIO:
Appellant absent from 14/07/2007 to 2/10/2008 without ratification and sanction from bank, copy of
respective document and guidelines provided to appellant.
List with name designation of the non recipients of this award despite completion of 25 yrs of service and
grounds for that is not maintained by bank.

Grounds for First Appeal:
Letter regarding absence of appellant is not enclosed in the reply of PIO. List with name designation of
the non recipients of this award despite completion of 25 yrs of service and grounds for that not provided.
Information not provided within 30 days.

Order of the First Appellate Authority:
CPIO has already provided the information sought along with copy of letters as asked by appellant, CPIO
can't decide the entitlement for award. Such is list is not maintained and cannot be provided.

Grounds for Second Appeal:
   1. List with name designation of the non recipients of this award despite completion of 25 yrs of
      service and grounds for that not provided.
   2. Information not provided and appellant not satisfied with Order of First appellate authority as bad
      as per law.
   3. Information not provided within 30 days.
 Relevant Facts

emerging during Hearing:

The following were present:

Appellant : Mr. Sumit K Bose on video conference from NIC-Kochi Studio;
Respondent : Mr. Chitranjan Sahai, PIO & AGM(Law) on video conference from NIC-Kolkata Studio;

The Appellant had sought information about list with name designation of the non recipients of
this award despite completion of 25 yrs of service and grounds for that was sought as information. The
PIO has stated that this information is not available and is not being maintained. The PIO has reiterated
this statement and the Commission is able to see that it is unlikely that the bank would have maintained
information of this nature for various years. However, this statement should be available for the last one
year and the Commission directs the PIO to obtain the information for the last one year and provide it to
the Appellant. In case it is claimed by the PIO that the information is not available even for one year in
any office of the bank he will make this statement in writing to the Appellant.

Decision:

The Appeal is allowed.

The PIO is directed to provide the information as directed above to the Appellant
before 30 September 2011.

This decision is announced in open chamber.

Notice of this decision be given free of cost to the parties.
Any information in compliance with this Order will be provided free of cost as per Section 7(6) of RTI Act.
