This  second­appeal  was  heard  through  videoconference  (VC)  on 
08.04.2010.    Appellant,  who was  notified  to be present  at the NIC  VC 
facility   at   Jagatsinghpur,   was   absent   when   the   hearing   commenced. 
Respondents  ―  represented by Shri P.K. Nanda, CPIO  ―  were present 
at the  same  venue.    Commission  conducted  the  hearing  from  its  New 
Delhi office.

2. Appellant, through his RTI­application dated 21.08.2009, asked for 
the following:­

“True copies of the written examination papers & Viva­Voce papers  
of   Shri   Subhakant   Dash   and   self   held   on   21st  June,   09   &   19th 
August,   09   respectively   marks   obtained   thereon   along   with   the  
marks   distributed   in   careers,   experiences   sports   and   extra  
curricular activities of Shri Subhakant Dash and self.”

3. During the hearing, it was stated on behalf of the respondents that 
they had provided to the appellant his own marks secured in the above 
examination.     The   marks   of   the   third­parties   /   candidates   were   not 
provided.

4. Appellant has now come up with a plea for disclosure of the marks 
obtained by a third­party, Mr.S.K. Dash and also to be allowed access to 
the answer­scripts not only of himself, but also of Mr.Dash’s.

5. Since this was an internal examination of the public authority, it is 
quite in order if the marks obtained by not only the appellant but also the 
third­party be disclosed to him.  This may be done within one week of the 
receipt of this order.

6. As   regards   the   answer­scripts,   in   terms   of   Commission’s   Full 
Bench   decision   in  Shri   Rakesh   Kumar   Singh   &   Ors.   Vs.   Lok   Sabha  
Secretariat, Delhi Jal Board, Diesel Loco Workshop and C.B.S.E.; Appeal  
No.CIC/WB/A/2006/00469;   &   00394;   CIC/OK/A/2006/00266;   00058;  
00066   &   00315;  Date   of  Decision:   23.4.2007, the   answer­script  of   the 
appellant  may  be  allowed  to  be  shown  to him within  one   week   of  the 
receipt of this order.

7. As   regards   the   third­party­answer­scripts,   there   shall   be   no 
obligation for its disclosure.

8. Appeal accordingly disposed of.

9. Copy of this direction be sent to the parties.
