Facts
arising from the Complaint:
The Complainant filed a RTI application with the PIO/AE, MCD on 16/03/2010 seeking certain
information. However, on not receiving the information within the mandated time, a Complaint was
filed under Section 18 of the RTI Act which was received by the Commission on 11/05/2010. On this
basis, the Commission issued a notice to the PIO on 12/05/2010 with a direction to provide the
information to the Complainant before 06/06/2010 and an explanation for not furnishing the
information within the mandated time. The Commission received a letter dated 16/06/2010 from the
PIO/ SE enclosing the reply of the EE dated 15/06/2010 and sent to the Complainant on 15/06/2010.
The PIO/ SE in the letter dated 16/06/2010 stated that the RTI application was received at his office
only on 19/05/2010 along with the notice of the Commission. The Commission also received a letter
from the Complainant dated 28/06/2010 stating that the information provided by the PIO was
incomplete and that the relevant annexures had not been enclosed.
Observations:
On perusal of the papers, the Commission has observed that the relevant annexures in response to
queries 2 and 3 have not been enclosed along with the PIO’s reply. Further, as regards query 1, the
PIO/ SE is required to seek assistance under Section 5(4) of the RTI Act from the department
concerned and provide the requisite information to the Complainant.
Decision:
The Complaint is allowed. The PIO/ SE is directed to seek assistance from the department concerned
under Section 5(4) of the RTI Act and provide the information sought to the Complainant under query
1 before August 17, 2010. The PIO/ SE is further directed to provide the relevant annexures under
queries 2 and 3 before August 17, 2010.
Notice of this decision be given free of cost to the parties.
Any information in compliance with this order will be provided free of cost as per Section 7(6) of RTI
Act.
