FACTS

:

1. It appears that some disciplinary proceedings have been initiated against the appellant
and it is, in this connection that he has sought information on two points from CPIO vide his
letter of 13-05-2008

2. The CPIO vide letter dt.27-05-2008 had informed the appellant that as the requisite
document was available with the Disciplinary Authority, the requisite document could not be
furnished to him. On appeal, the First Appellate Authority had upheld the decision of the CPIO.

3. The present appeal is directed against the order of Public Information Officer/First
Appellate Authority. The matter was heard on 02-02-2009. The appellant appeared before the
Commission. The Public Authority is represented by the Officer named above.

4. During the hearing the appellant produced a copy of charge sheet dated 10-07-2006
served on him wherein Article 5 of the charge inter-alia, read as follows:

“…………….. he was caught red handed by Deputy Director (Women Education) while
writing petition in the class room to the outside authority by blaming the administrative activities.”

The appellant has requested for a copy of the letter/report purported to have been
prepared by the then Deputy Director (Women Education).

5. Shir S. Sundaravadivelu would submit that a copy of this letter is available in the file of
the Disciplinary Authority. He assures that he will obtain the same from the Disciplinary
Authority and supply it to the appellant.

DECISION:

6. In view of the assurance of Shir S. Sundaravadivelu, he is hereby directed to obtain a
copy of the relevant letter from the Disciplinary Authority and furnish the same to the appellant in
3 weeks time.

7. The matter is disposed of subject to the above directions.
