Background
1. The Applicant filed an RTI application dt.17.7.07 with the CPIO, SER,
Chakradharpur. He requested for information against 36 points on various
issues related to the construction of Tomka-Kendujhargarh (KDJR) Broad
Gauge Line and its handing over to the Open Line including estimated cost,
list of materials issued in the project, etc..
ii) List of materials issued in this project by Rail Vikas Nigam Limited.
iii) Various reports in connections with the construction of Tomka-KDJR
BG Line.
ii) Date of handing over of the Tomka – KDJR BG Railway line to the open
line
ii) What is the estimated cost of above project till handing over to the
open line in detailed such as rail linking, signaling, Ballast filling etc.
iii) The work done by agency in this project is according to technical
specification prescribed in Bid documents – volume – II (Section 4 Para II)
Technical specification or not.
The CPIO replied on 5.9.07 stating that information sought has been
furnished vide letter dt.30.8.07. Not satisfied with the reply, the Applicant
filed an appeal dt.30.8.07 with the Appellate Authority. The Appellate
Authority replied on 1.10.07 stating that all the information has been
provided except against those where opinion/advise has been sought.
Aggrieved with the reply, the Applicant filed a second appeal dt. 27.1.08
before the CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for June 18, 2009.
3. Mr. M.K. Gupta, CBE/PIO, Mr. K.G. Agrawal, Dy. CE (R&S), Mr. N. Nayak, Dy.
CE/C and Mr. P. Panda, CA to CBE represented the Public Authority.
4. The Applicant was not present during the hearing.
Decision
5. The Commission reviewed the information that was provided to the Appellant
in 5 installments – on 8.8.07, 10.8.07, 30.8.07, 5.9.07 and 19.9.07
numbering 41 pages and noted that while the Appellant has stated that he
has not received correct information relevant to the questions he had asked,
he has not given any details of either the missing information or the
information which is not correct . In the absence of such details, the
Commission holds that all available information has been furnished to the
Appellant and accordingly disposes of the appeal.
