                                         ORDER

   The Central Information Commission has received a complaint petition  dated 
 
21.12.2010 from Shri Udai Singh Meena, under the RTI Act 2005, against Rajasthan 
Drugs & Pharmaceuticals Ltd., Jaipur relating to his RTI­application dated 02.12.2010. 

2.      Perused the papers submitted by the  complainant. It is observed that vide 
letter   No.   RDPL/CPIO.TRI/30/2010/7055     dated   20.12.2010,   the   CPIO   already 
furnished the reply to the complainant to his RTI­application dated 02.12.2010. CPIO 
also advised the complainant that in case he was not satisfied with the reply of the 
CPIO, he may file his first­appeal before the First Appellate Authority (FAA).   

3. However, instead of approaching the FAA, the complainant filed his complaint 
before the Commission. In order to avoid multiple proceedings under section 19 and 18 
of the RTI Act, viz., appeals and complaints, the following directions are issued:

i) The complainant Shri Udai Singh Meena is advised to file his first­appeal in the 
matter before the First Appellate Authority (FAA), within 2 weeks of the receipt 
of this order. 

ii) The FAA is directed that on receipt of such first appeal, he shall dispose it of  by 
passing a speaking order, within 4 weeks of the receipt of said appeal.  

iii) If the appellant is still not satisfied with the decisions of FAA, he shall be free to 
approach the Commission in fresh 2nd  appeal under Section 19(3), along with 
complaint, if any, under section 18, within the prescribed time limit.

4.  With the above directions, the case is closed at the Commission’s end.
