Background
1. The Applicant filed an RTI application dt.19.11.08 with the CPIO, NACO. He
requested for information against 8 points and several sub points including
the dates on which the post of Joint Director, IEC were advertised under
NACP3, the number of candidates who were called for the written exam, the
copies of applications from all those who appeared for the written exam, the
date of the examination and the names of the selection committee along with
the copy of the questionnaire etc. Part information on point 12 and 13 was
sent to the Applicant vide letter dated 28.1.09 and subsequently remaining
information was sent vide letter dated 5.3.09. Meanwhile the Applicant filed
a first appeal dt.24.2.09 with the Appellate Authority but by that time,
information on all the 16 points in his application were supplied to him. The
first Appellate Authority replied in 19.3.09 asking him to deposit Rs.74/- for
photocopying of 37 documents. However, not satisfied with the reply the
Applicant filed a second appeal dt.20.3.09 before CIC stating that he is not
satisfied with the information against point 2(ii), 3(iii), 6, 9 , 11, 13, 14, 15
and 16 of his RTI application. An interim reply was sent to the Appellant on
31.3.09. Vide letters dated 9.6.09 and 11.6.09, clarifications against all the
points mentioned in the second appeal were furnished to the Appellant.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for June 17, 2009.
3. Mr. J.P. Mehta, Dy. Secretary cum CPIO, Mr. V.K. Govil, S.O and Mr. Sanjeev,
OA represented the Public Authority.
4. The Applicant was not present during the hearing.
Decision
5. The Respondents submitted that vide letters dated 9.6.09 and 11.6.09,
clarification against all the points mentioned in the second appeal was
furnished to the Appellant. On perusal of the information provided, the
Commission observed that complete information has been provided to the
Appellant and accordingly disposes of the appeal .
