Background
1. The Appellant filed his RTI application dt.17.9.08 with the CPIO, BSNL. He
requested information against 4 points with regard to implementation of
Order 3003/IC/A/2008 dated 6.8.08. On not receiving any reply, he filed an
appeal dt.10.11.08 with the Appellate Authority. Aggrieved at not receiving
any reply, the Appellant he filed a second appeal dt.26.12.08 before CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for February 19, 2009.
3. Mr. Suresh Kumar DGM (MIS) and CPIO and Mr. Joginder Singh, AGM(RTI)
represented the Public Authority.
4. The Applicant’s representative Mr. Bimal Kumar Khemani came late for the
hearing, only after the Respondents left.
Decision
5. The Commission directs the CPIO to provide all the information as sought in
the RTI request. The Commission also directs the CPIO to show cause as to
why a penalty of Rs.250/- per day should not be imposed on him for not
replying within the mandatory period as stipulated in the RTI request. The
response to the showcause notice to be sent to the Commission within 15
days of receipt of this Order. Information to be provided to the Appellant
within 15 days of receipt of this Order.
6. The appeal is disposed off
