                                        ORDER

Shri V. Mahadevan, the appellant has filed this appeal dated 14.10.2010 before the
Commission against Directorate of Indian Systems of Medicine & Homoeopathy,
Puducherry, for providing false and wrong information to his RTI-request dated 6.4.2010,
which came up for hearing on 03.05.2011 through videoconferencing. The appellant was
present in person, whereas the respondents were represented by Dr. Balaji, Director &
FAA and Ms. Rajani Ram, PIO at NIC videoconferencing facility, Puducherry.

2. The appellant filed RTI-request dated 6.4.2010 seeking information on two RTI-
queries pertaining to an incident of unauthorized copying and carrying away of computer
data files or computer intellectual property material during the month of December, 2008.
The PIO vide letter No. 3316/DISM&H/E2/RTI/2010 dated 4.5.2010 has provided point-
wise information to the appellant.

3. Aggrieved by the decision of PIO, the appellant filed first-appeal on 31.5 .2010
before FAA. The FAA vide order No. 11165/DISM&H/E2/2009 dated 6.9.2010 has upheld
the decision of PIO.

4. During the hearing the appellant submitted that respondents have provided false
and incomplete information and in particular not provided copy of complaint which was
sought against Point No. 2(d).

5. The respondent, on the other hand submitted that the identity of the complainant/
complainants cannot be revealed in terms of Section 8(1) (g) of the RTI Act.

6. After hearing the parties and on perusal of the relevant documents on file, the PIO
is directed to provide information in respect of Point No. 2(d) – containing gist of the
complaint, without revealing the identity of complainant or complainants, within two
weeks of the receipt of this order.

The appeal is disposed of with the above directions.
