Background
1. The Applicant filed an RTI application dt.20.7.09 with the PIO, Govt. Medical Store Depot requesting
for the following information with regard to the letter dt.31.3.09 in which it was stated that one post of
Chowkidar and one post of Mazdoor is lying vacant since 1.8.08 and 1.12.08:
i) Why were the appointment not given to any person on compassionate ground since
26.3.1996.
ii) How many persons were appointed since Dec.1999. What were their posts and on what
grounds were the appointments made.
iii) What are the procedures of appointing the person on the post of Mazdoor and Chowkidar
iv) How many Mazdoor and Chowkidars were given appointments in GMSD Delhi. What were
their ground of appointments.
v) Do you publish the vacancies or get them from employment exchange, please furnish the
details of all such appointments after Dec.1999.
vi) To provide the details of their employment exchange and publication of these employments.
vii) How many vacancies were in your office on compassionate grounds since Dec.1999. Who
were given appointments. If not, why?
viii) Since there is one vacancy of mazdoor and one vacancy of Chowkidar in your office, can
you fill them on compassionate ground. If not, why?
Shri D.S.Rao, Dy. Asst. Director General (Stores) replied on 27.8.09 stating that no post is lying
vacant in his office within prescribed 5% quota. Not satisfied with the reply, the Applicant filed a
complaint dt.17.9.09 before CIC stating that out of 9 questions, information was provided against only
one point.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the hearing for July 22,
2010.
3. Shri T.K.Sarkar, CPIO and Shri R.L.Kaplash, Supdt. Admn. represented the Public Authority.
4. The Applicant was present along with Shri Unchal Rattan Singh during the hearing.
Decision
5. After reviewing the information sought and reply provided there to, the Commission directs the PIO as
follows:
i) to provide information against points 6 and 7.
ii) With regard to point 1, the PIO is directed to submit an affidavit to the Commission with a
copy to the Appellant stating that no post is lying vacant in the office within prescribed 5% quota is
true and is as available as per records.
6. The information to be provided by 22.8.09 and the Appellant to submit a compliance report to the
Commission by 29.8.09.
7. The appeal is disposed of with above directions.
