Background
1. The Applicant filed an RTI application dt.6.8.08 with the CPIO, DoP, Rewa
(Copy not in file). He wanted to know whether Mr. Avinash Mishra was
employed under the handicapped quota and also a copy of his service book.
The CPIO replied on 26.8.08 denying the information under Section 8(1)(j) of
the RTI Act. Not satisfied with the reply, the Applicant filed an appeal
dt.26.8.08 with the Appellate Authority. The Appellate Authority replied on
24.10.08 denying the information under section 8(i)(j) and upheld the
decision of the CPIO. Aggrieved with the reply, the Applicant filed a second
appeal dt.11.2.09 before the CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for May 29, 2009.
3. Mr. A.K. Jain, Asstt. Supdt. of Post Office, Rewa represented the Public
Authority.
4. The Applicant was not present during the hearing.
Decision
5. The Respondent submitted that information has been denied under Section
8(1)(j) and under Section 11(1) of the RTI Act after taking a written
submission from Mr. Mishra. The Commission, after reviewing the information
provided, directs the CPIO to provide information regarding Mr. Avinash
Mishra’s recruitment under quota for handicapped,to the Appellant and with
regard to the second point in the RTI application, upholds the decision of the
Appellate Authority and denies copy of service book of Mr. Mishra to the
Appellant under Section 8(i)(j) of the RTI Act since the information belongs to
the third party and its disclosure has no relationship with any public activity
or interest.
