Background
1. The Applicant filed his RTI request on 01.05.09 with the Secretary, Medical
Council of India, New Delhi seeking information regarding starting of MCH
course at PL B D Sharma P6IMS, Rohtak u/s 10A of the IMC Act, 1956. In this
connection he sought information against 5 points. The PIO replied on
19.06.09 stating that information related to point 1 to 3 is third party
information under Section 11 of the RTI Act, 2005 and that the RTI
application is being forwarded to the concerned institute where doctors about
him information has been sought by the Appellant are employed with a
request to send the information directly to the Applicant. With regard point 4
he enclosed copy of inspection reports and against point 5 he stated that the
information sought is not information as defined under Section 2(f) of the RTI
Act, 2005. Not satisfied with the reply the Applicant filed his First Appeal on
09.07.09 which was received by the First Appellate Authority on 14.07.09 and
replied to on 21.08.09 while providing further information. Still not satisfied
with the reply, the Applicant filed his Second Appeal before the Commission
requesting for information.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner scheduled the
hearing for 8th March, 2010.
1. Mrs.Madhu Handa, Asstt. Secy cum PIO, Mr.J.S. Bhasin, Advocate
represented the Public Authority.
4. The Appellant was present during the hearing.
Decision
5. On perusal of submissions of both sides the Commission noted that
information has been provided against points 1, 2 and 4. With regard to point
3 seeking teaching experience of Dr.R.B. Singh as per requirements of MCI,
the Commission directs the Respondent to provide the information available
in the files of MCI as the same is not third party information but is
information about medical expertise of the Doctors which by no means can
be considered as personal information. Against point 5 regarding
Postgraduate Medical committee meeting, the Commission directs the
Respondent to allow inspection of relevant files by the Appellant and to
provide attested copies of relevant documents, desired by him in connection
with point 5 only. . The exercise to be completed by 5 April, 2010.
6. The appeal is accordingly disposed of.
