Heard learned counsel for the parties.

In this case, petitioner is seeking direction to the

respondents to provide 21% reservation on the post of Lecturer

(Home Science) for OBC category in the total vacancies of

current year. Further it is prayed that if petitioner comes within

the preview of posts reserved for OBC category then her

candidature may kindly be considered for appointment on the

post of Lecturer (Home Science).

The petitioner has applied for recruitment on the post

of Lecturer (Home Science) in pursuance of advertisement issued

by RPSC in the category of OBC and claiming her right on the

ground that vacancies were not correctly determined.

In ground (A) of the reply, it is specifically stated by

the respondents that reservation has been provided as per

Roster and out of 41 posts, 9 posts were backlog vacancies and

in remaining 32 posts, reservation has been provided as per

Rules in which there is no illegality.

I have perused the advertisement. When specific

reply has been filed clarifying the correct position, then in my

opinion there is no illegality in determination of vacancies

because out of 41 posts, 9 posts were filed in as backlog

vacancies and for remaining 32 vacancies reservation has been

provided as per roster which is in accordance with rules.

In this view of the matter, there is no force in the

writ petition. Hence, this writ petition is dismissed.
