ORAL
ORDER

(Per
: HONOURABLE THE CHIEF JUSTICE MR. S.J. MUKHOPADHAYA)

Writ
petition in the public interest was preferred by the petitioner
alleging noise pollution caused by 5th respondent.
Initially, the Court having found the level of noise pollution much
above 55 decibels ordered to close the unit. 5th
respondent was directed to take correctional measures and the Gujarat
Pollution Control Board was directed to take fresh measurement of
noise pollution after correctional measures are taken by 5th
respondent.

The
case was subsequently taken up and it was informed by 5th
respondent that correctional measures have already been taken.

The
Gujarat Pollution Control Board submitted a report from which it
appears that the noise level of 5th respondent is 55
decibels in day time and about 45 decibels in the night.

In
the facts and circumstance, no further order is required to be passed
in this case.

The
writ petition stands disposed of. No costs.
