Background

1. The Appellant filed an RTI request dt.16.11.07 with the CPIO, National
Library. The Appellant requested for information against 22 points.
The PIO replied on 24.12.07 providing point wise information. Not
satisfied with the reply, the Appellant filed an appeal dt.9.1.08 with
the Appellate Authority stating the reasons for filing an appeal. The
Appellate Authority replied on 28.1.08. Not satisfied with the reply,
the Appellant filed a second appeal dt.30.4.08 with the CIC. The CIC
vide letter dt.14.7.08 sought comments from the respondents. The
respondents submitted a rejoinder dt.24.7.08 to the CIC.

2. The Bench of Mrs. Annapurna Dixit, Information Commissioner,
scheduled the hearing on January 7, 2009.

3. Mr. Tapan Sarkar, LIO and Mr. M. Kabasi represented the Public
Authority.

4. The Appellant was not present during the hearing.

Decision

5. The Respondent submitted that the CPIO who was dealing with the
case retired around 4 months ago and that all information had been
provided on 24.12.07. Since the CPIO has retired, the Commission
takes a lenient view and has decided not to levy any penalty on him
for not having complied with Section 4 of the RTI Act.

6. The appeal is disposed off.
