                            JUDGMENT

The petitioners, who are students who passed M.B.B.S.

Examination from the 3rd respondent’s College challenge Ext.P4

order passed by the 1st respondent wherein the provisional

registration of the students of the 3rd respondent’s College under

the Travancore-Cochin Medical Practitioners’ Act, with which only

they can start their internship, completion of which is mandatory

for obtaining M.B.B.S degree, has been refused on the ground

that the Medical Council of India has not given final recognition to

the College.

2. The learned Standing Counsel for the Medical Council

of India produced before me a communication from the Medical

Council of India to the Secretary, Government of India, Ministry

of Health & Family Welfare dated 21.5.2008 recommending final

recognition for the 3rd respondent’s College.

3. The petitioner today produced before me a

notification from the Secretary, Government of India, Ministry

of Health & Family Welfare Department, which according to the

petitioners is the final notification granting recognition to the

3rd respondent’s College. In the above circumstances, the writ

petition is disposed of with the following directions:

If the petitioner produces the document, now produced

before me for my perusal, before the 1st respondent, the 1st

respondent shall consider the same and if the same is

sufficient to grant provisional registration to the petitioners,

the 1st respondent shall issue appropriate orders in the matter,

as expeditiously as possible, at any rate, within a period of two

months from the date of receipt of a copy of this judgment.
