                             JUDGMENT

The petitioner is engaged in the business of sale of flooring

materials. He has engaged three registered workers to do the

loading and unloading work in his establishment. Since the

service of additional attached workers were found to be

necessary the petitioner has engaged five other workers to do the

loading and unloading work in his establishment. It is stated that

the said five workers have filed applications seeking registration

as headload workes under rule 26A of the Kerala Headload

Workers Rules, 1981. The grievance voiced by the petitioner is

that till date orders have not been passed thereon. In this writ

petition the petitioner seeks a direction to the respondent to

consider Exts.P2 to P6 applications and pass orders thereon

expeditiously.

2. Sri.Basant Balaji, learned Government Pleader appearing

for the respondent submitted on instructions that the originals of

Exts.P2 to P6 were received only on 10.1.2011 and that under the

provisions of rule 26A of the Kerala Headload Workers Rules, the

Assistant Labour Officer is bound to issue notice to the Chairman

of the District Committee of the Kerala Headload Workers Welfare

Board and the petitioner before passing orders on the

applications. The learned Government Pleader submitted that the

respondent will pass expeditious orders on Exts.P2 to P6

applications after following the prescribed procedure. In the light

of the said submission, as the respondent has admittedly received

Exts.P2 to P6 applications I dispose of the writ petition with a

direction to the respondent to consider the same and pass orders

thereon expeditiously and in any event within one month from the

date on which the petitioner produces a certified copy of this

judgment before him, after following the procedure prescribed in

rule 26A of the Kerala Headload Workers Rules, 1981.
