. Heard learned counsel appearing for the petitioner and learned counsel
appearing for the B.C.C.L on an interlocutory application bearing no.2816 of 2011
wherein prayer has been made to allow him to incorporate the prayer challenging the
order dated 3/5.9.2011 wherein Bank Manager, Punjab National Bank,Bank More,
Dhanbad has been asked to forfeit the bank guarantee.
It be recorded that the order of suspension of the fuel supply agreement
and also the order terminating that agreement is under challenge in this writ
application.
Under the circumstances, prayer made in the interlocutory application is
allowed. Let the I.A form part of the writ application.
As prayed for, put up this case after six weeks to enable learned counsel
appearing for the B.C.C.L to file counter affidavit to the main application as also
rejoinder to the Interlocutory application.
Till then, Bank Guarantee furnished by the petitioner shall not be invoked,
if it has already not been invoked.
