As per direction of this court Mr.Vishal Dixit, learned counsel for the
opposite party No.1 placed the statement of Account of M/s.J.R.Organics Ltd.
i.e. Account No.00782320008229, H.D.F.C. Bank, M.G.Road, Hazratganj,
Lucknow, in which closing balance as on 4th of May, 2010 is
Rs.111,113.95. However, he submits that the petitioner’s principal claim is
about Rs.33 lakhs. Though the opposite parties dispute the same, but the
same may be kept in the account safely in the interest of justice subject to
further orders of this court.
Though the petitioner claims something more than that i.e. Rs.50 lakhs
alongwith accrued interest on the principal amount, but keeping the
submission of both the parties, at this stage I feel it appropriate to order that
the amount of Rs.33 lakhs, which is the principal amount, shall be kept in the
aforesaid account without operation, which shall be subject to further orders
of this court. The Bank shall follow the direction issued by this court and the
opposite party No.1 i.e. M/s.J.R.Organics Ltd. is warned not to operate the
account to the extent of the aforesaid amount.
List in the 1st week of August, 2009 for final hearing.
