                                                         ORDER

Background

1. The  Applicant  filed  an   RTI   Application  dt.24.5.11 with the PIO, O/o  DDE(NW­A),  GNCTD.    She 

sought  monthwise  details  of  the salary paid to the eleven teachers (names indicated in the RTI 

Application) by Sant Nirankari Public School from the date of their appointment till 31.3.10.  The PIO 

replied on 22.6.11 enclosing the reply dt.8.6.11 furnished by the Principal of the School who stated 

that as per their understanding the date of appointment of a teacher is deemed to be from the date of 

recognition of the school or the actual date of joining whichever is later.  She added that they were 

able   to   retrieve  the  old  salary   registers  with effect from  April  1990 except 1998  and invited  the 

Applicant to visit the office on working days and note the information required.  The Applicant filed an 

appeal dt.12.7.11 with the Appellate Authority stating that information asked for is of eleven teachers 

and not nine teachers.   Besides the information asked for needs authentication and that can only 

serve the purpose if it is furnished through the education department.  Dr.Sunita S.Kaushik, Appellate 

Authority replied on 1.8.11 stating that on careful examination of the  documents, it is found that the 

information provided by the PIO is not complete and directed the PIO to provide the information within 

ten days.  The Applicant filed a second appeal dt.24.8.11 before CIC requesting for the information.

Decision

2. During the hearing, the Respondents submitted that information as sought by the Appellant, month­

wise  for the last 3 years 2008­2009, 2009­2010 and 2010­2011has been compiled and is ready to be 

furnished to the Appellant.  With the permission of the Commission , a copy of the same was handed 

over to the Appellant’s representative during the hearing.     The Respondents also pointed out that 

information   sought   is   voluminous  as  the   Appellant  is   seeking   monthwise  payment  details  of   11 

teachers   for   over   15   years   and   that   compilation   of   information   will   disproportionately   divert   the 

resources of the Public Authority. 

3. The Commission on perusal of the information sought  and after hearing the Respondents is of the 

opinion that compiling details of monthwise pay of  11 teachers for more than 10years(leaving out the 

period for which information has already been provided)  would indeed disproportionately divert the 

resources of the Public Authority as per section 7(9) of the RTI Act and hence directs the   PIO to 

allow the Appellant to inspect the relevant records over two consecutive days so that the Appellant 

can glean for himself the information required by him . In the event the Appellant seeks copies of 

documents,  the  same  may  be  provided at Rs.2/­ per page as photocopying charges. The entire 

exercise  to   be   completed   by     17.12.11  and  the  Appellant  to  submit  a  compliance  report  to  the 

Commission by 24.12.11.

4. The appeal is disposed of with the above directions.
