seeks permission to withdraw this writ petition with liberty to the petitioner 

to move before the appellate forum.

It   goes   without   saying   that   while   considering   the   prayer   for 

condoning the delay, the pendency of this writ petition in this Court from 

27/01/2011 will be considered.

With   these   observations   and   the   liberty   aforesaid,   this   writ 

petition is permitted to be withdrawn.
