FACTS

:

The appellant has sought information under RTI Act by his application
dated 3.5.2007 regarding refund and withdrawal of membership amount
from the public authority. The PIO vide letter dated 14.5.2007 has given a
reply to the appellant. Not satisfied the appellant preferred appeal before
the first AA on 16.5.2007. The first AA has disposed of the appeal by order
dated 31.05.2007 after personally hearing the appellant and the PIO on
22.5.2007. The AA has ordered the PIO to refund the share/NRF amount
payable to the appellant within 2 weeks. Having not received refund the
appellant preferred this appeal before the State Information Commission
which has been transferred to this Commission as the State Commission
was wound up.

DECISION:

2. This case came up for hearing on 24.7.2008, which was attended by
the concerned officials of the Department. The appellant attended the
hearing in person. I have gone through the RTI application and other
replies received in this connection. The parties were heard in detail. It is
learnt during the hearing this case is exactly similar to the case of Mr.
K.Darmarajan which was also heard and disposed on the same day.
Hence, this case is also disposed of the on same lines.

Let a copy of this decision along with a copy of the decision in the
case of Mr. K.Darmarajan be sent to the appellant and CPIO.
