Mr.Mittal states that on 17.12.2003, the direction was given to

the appellant to furnish fresh address and complete particulars of the

Managing Director of the respondent firm. He further puts that he has made

numerous telephone calls and has written number of letters to the appellant

in this regard but the appellant never responded.

In these circumstances, he has to say nothing. The appellant

appears to be disinterested to pursue this appeal. Sequelly, this appeal is

dismissed for non-prosecution.
