Judgment

Basheer, J:

When this case came up for consideration on March 24,

2010 it was submitted by learned counsel on either side that the

matter has been compromised between the parties. The

compromise petition dated March 18, 2010 was in fact filed by the

parties indicating the terms of settlement, one of which was that the

appellant would pay Rs.2,50,000/- to respondent No.2 towards full

and final settlement of the claim in ID.No.25 of 2000 on the file

of the Industrial Tribunal, Alappuzha. In the compromise petition

it was further stated that a sum of Rs.75,000/- had already been

paid to respondent No.2 on March 6, 2010 and a further sum of

Rs.1,25,000/- would be paid by the appellant in two instalments of

Rs.50,000/- and 75,000/-, respectively on April 30 and May 31,

2010. It was further agreed that the amount of Rs.50,000/- lying in

deposit before the Industrial Tribunal Alappuzha will be permitted

to be withdrawn by respondent No.2.

2. Today when the case is taken up for further

consideration, learned counsel for the parties submit that the

amounts which were agreed to be paid by the appellant had already

been paid. What remains is only a sum of Rs.50,000/- which is

now lying in deposit before the Tribunal.

3. Learned counsel for the appellant submits that the

appellant has no objection in allowing respondent No.2 to

withdraw the same from the Tribunal. The above submission is

recorded.

4. The compromise petition is taken on record. It shall

form part of this judgment. The Industrial Tribunal shall release

the amount of Rs.50,000/- now lying in deposit, to respondent

No.2.

The Writ Appeal is closed.
