Sri R.N.Singh, the learned Senior counsel appearing on behalf of the
petitioners submits that inspite of the directions the State Government has not
taken any decision nor has filed any counter-affidavit in terms of the order
dated 9.9.2009. The laches on the part of the State government reflects its
working. We are left with no option except to call upon the Principal
Secretary, Housing & Urban Development, Government of U.P. to appear in
person on 9.2.2010. It is made clear that in the meantime if the State
Government takes decision, a copy of which shall be provided to the
petitioners and the authority need not appear in person.
This order shall be communicated to the concerned authority by Sri Habib
Ahmad, the learned Standing counsel and Sri Anil Tiwari, the learned counsel
for respondent No. 2.
