This writ petition was filed for the release of goods detained by the
respondents on 20.11.2001. By an interim order dated 13.12.2001
the goods were directed to be released on petitioner’s furnishing a
security other than cash and bank guarantee to the extent of the
amount of tax payable on the ceased commodities to the
satisfaction of the respondent no. 4.
The State of U.P. filed Civil Appeal No. 8091/2002 in the Apex
Court. By the judgment dated April 29, 2008 the Supreme Court
dismissed the Civil Appeal; vacated the interim order dated
12.4.2002 and requested Hon’ble the Chief Justice of the High
Court to list the writ petition for disposal as early as possible.
Shri Agrawal informs that the goods were released. On a statement
given by the counsel for petitioner on 5.7.2007, that the writ
petition has become infructuous, the Court had dismissed the writ
petition and vacated the interim order on 5.7.2007.
The writ petition was dismissed before the Civil Appeal was
dismissed by the Supreme Court. No further orders are required to
be passed in the matter. Let the file be consigned.
