It has been brought to our notice that the application filed by the
petitioner for grant of No Objection Certificate before the U.P.
Pollution Control Board has been rejected.

In view of aforesaid, Mr. Shashi Nandan, Senior Advocate,
appearing on behalf of the petitioner, prays for withdrawal of the
petition with liberty to the petitioner to take recourse to such other
remedy as is available to it in law for assailing the said order.

Mr. Nand Lal Maurya appears on behalf of the Pollution Control
Board.

Petition stands dismissed as withdrawn with liberty aforesaid.
