The learned counsel for the petitioner submits that subsequent to

the filing of this original petition, further appellate orders have been

passed in respect of the same subject matter, which have been

challenged in W.P.(C).No.23403/2007, which is pending. Therefore,

the counsel for the petitioner seeks permission to withdraw this

original petition without prejudice to the right of the petitioner to

prosecute W.P.(C).No.23403/2007. Permission is granted and the

original petition is dismissed as withdrawn with the above liberty.
