The brief facts of the case are as under.
2. The Appellant had approached the CPIO in her letter dated 24.2.2007
seeking a number of information in regard to the payment made to one Shri B.N.
Mishra in pursuance of the order of the Hon’ble High Court at Allahabad. It is
not clear as to what exact reply or information the CPIO provided to her.
However, not satisfied with whatever response she got from the CPIO she filed an
appeal before the First Appellate Authority which that Authority decided in his
order dated 23.4.2007. The Appellate Authority held that the Bank released
certain payments to Shri B.N. Mishra as per the orders or the Hon’ble High Court
at Allahabad. He directed the CPIO to release whatever information he has
within 15 days of his order. It is not clear if the CPIO implemented the orders of
the Appellate Authority within the stipulated period. The Appellant has now
approached this Commission in Second Appeal.
3. During the hearing, the Appellant was absent in spite of notice. We
however, carefully examined her Appeal Memo as also the documents enclosed
with that. We heard the submissions of the Respondent. We were told during
the hearing that the CPIO, in compliance of the orders of the First Appellate
Authority, had indeed sent a copy of the order of Hon’ble High Court at
Allahabad to the Appellant. We now direct the CPIO to provide the remaining
information sought by the Appellant in her original application, dated 24.2.2007
if available, within 10 working days from the receipt of this order. In case any
information is not available, he should clearly state so in his reply.
4. With the above direction this Appeal is disposed off. Copies of this order
be given free of cost to the parties.
