This second-appeal by Ms.Prachi Pramod Desai (appellant) is against the
order dated 11.01.2008 of the Appellate Authority (AA) corresponding to
appellant’s RTI-application dated 02.11.2007 and CPIO’s reply thereof dated
30.11.2007.

2. Appellant, through her RTI-application, sought the following
information:-

“(1) Copy of comments offered by ACAO on my petition.
(2) Enclosures, if any, attached to the comments (copies thereof)
(3) Copies of official notings on my petition as well as on ACAO’s
comments.”

3. Response to queries at Sl.No.(1) and (2) have been given to the appellant
on 30.11.2007 by the CPIO. As regards item (3), the CPIO stated that as the
enquiry was not yet complete, disclosure of file-notings shall be premature and
may lead to misleading conclusions.

4. To an enquiry from the Commission as to how long it would take for the
enquiry to be completed, the respondents stated that it could be over within 1
month.

5. It is directed that the respondents will disclose the file-notings to the
appellant within 6 weeks from the date of the receipt of this order. It is presumed
that the enquiry currently in progress would have been completed within this
time; if it is so, the file-noting shall be disclosed, but if for any reason the enquiry

is not completed with 4 weeks, then the respondents will disclose the file-notings
to the appellant even otherwise.

6. The respondents shall block out the names and the designations of the
officers recording the file-notings before disclosing it to the appellant.

7. Matter disposed of with these directions.

8. Copy of this decision be sent to the parties.
