Heard Sri Piyush Agrawal learned counsel for the assessee
revisionist and the learned standing counsel.
The matter relates to the provisional assessment. It is yet to
be decided.
Subject to the deposit of 50% of the disputed amount of tax,
as directed by the Tribunal, within a period of three weeks
from today, the impugned demand remain stayed till the
disposal of the appeal.
The appeal of the petitioner may itself be decided
expeditiously preferably within a period of three months. Till
the decision of the appeal, no further recovery may be made
against the petitioner. It is made clear that in case the
petitioner fails to deposit 50% of the amount as indicated
above, the stay order shall stand automatically vacated.
With the observations made above, the revision is disposed
of finally.
