Background:
Smt. S. Saiyamma of Ganjam, Orissa, filed an RTI-application with the
Public Information Officer, East Coast Railway, Khurda, on 12 October 2007,
wherein she wanted to know whether her son would get employment on
compassionate grounds based on her application dated 8 June 2007 addressed to
DRM (P).
2. The PIO vide his letter dated 15 November 2007 replied to the RTI-
application. Not satisfied with the reply of the PIO, the Appellant filed an
appeal with the first Appellate Authority on 21 November 2007 who vide his
letter dated 26 December 2007 replied to it. Thereafter, the Appellant
approached the Central Information Commission with a Second Appeal on 23
January 2008 which was registered in the Commission on 6 May 2008.
3. The Bench of Dr. O.P. Kejariwal, Information Commissioner, heard the
matter on 13 October 2008.
4. Shri R.L. Gupta, ADRM & PIO and Shri L.V.S.S. Patrudu, Sr. DPO,
represented the Respondents.
5. The Appellant, Smt. S. Saiyamma, was neither present nor send any
representative for the hearing.
Decision:
6. In the absence of the Appellant, the Commission heard the Respondents
and examined their response to the RTI-application of 12 October 2007 as also
the reply to the Appellant’s First Appeal of 21 November 2007. The Commission
noted that this was a case of compassionate appointment. It, therefore, advises
the Appellant to take up the issue at the appropriate level.
7. The case is thus disposed of.
