Heard learned counsel for the petitioner.

Submission of learned counsel for the petitioner is that as required by this
Court vide interim order dated 3.4.2008 an amount of Rs.34,754.04 and 50%
of the penalty amount has been deposited by the petitioner by 30.4.2008 and
on the aforesaid condition further recovery proceedings against the petitioner
were stayed. He further submits that in spite of the aforesaid compliance by
the petitioner the opposite parties are pressing upon the petitioner to deposit
the rest of the outstanding amount.

Considering the aforesaid facts, let notice be issued to opposite parties no.2
and 3 fixing 3.2.2010.
