ORAL ORDER

Mr.

Desai, learned advocate for the Official Liquidator, has made a
grievance that the property of the company is being used by the
lessee, however, any lease rent is not coming into the funds of the
Official Liquidator. Mr. Nanavati, learned advocate for the applicant
has submitted that the applicant is running the factory and under the
agreement, a sum of Rs.70 lacs has been paid, by way of returnable
deposit, to the company and the accrued interest is to be treated as
rent. The details about the said payment of Rs.70 lacs and its
present status are not available on record.

Mr.

A.L.Shah, learned advocate appearing for the respondent No.3 has
submitted that the respondent No.3 will file affidavit placing on
record the relevant facts, including the facts regarding the
aforesaid amount deposited by the applicant.

To
enable the respondent No.3 to file affidavit stating all the relevant
facts, hearing is adjourned to 15th December, 2010.
