Shri
P.M.Thakkar, learned Senior Advocate appearing for M/s.Thakkar
Associates appearing on behalf of the appellant and Shri A.J.Yagnik,
learned advocate appearing on behalf of the respondent-original
plaintiff, both have jointly submitted that by efflux of time and as
validity of the contract period is over, the order passed by the
trial court has become infructuous, and therefore, present appeal
from order does not survive. Accordingly appeal from order and the
civil application therein are dismissed as infructuous by efflux of
time and subsequent development. Interim relief, if any, granted
earlier shall stand vacated forthwith.
