Learned counsel for the petitioner submits that earlier petition

for pre-arrest bail preferred by the petitioner was dismissed as withdrawn on

12.05.2009. However, co-accused namely Rajnish @ Nishu was granted the

concession of anticipatory bail by this court vide order Annexure P-4.

According to the counsel, the present petition was preferred thereafter.

Learned counsel has further submitted that there was delay of two days in

lodging the FIR and the petitioner by now has joined the investigation

pursuant to order dated 19.06.2009.

Learned counsel for the State (on instructions from ASI

Mohinder Singh, who is present in court) does not dispute the fact that

petitioner has joined the investigation.

Keeping in view the fact that petitioner has joined the

investigation, the instant petition is allowed and the petitioner is granted the

concession of anticipatory bail subject to the conditions as envisaged under

Section 438(2) Cr.P.C.

However, it is made clear that petitioner shall report before the

investigating officer as and when required for the purpose of investigation.
