Heard learned counsel for the applicant and learned A.G.A. for the State.
The accused applicant Munna @ Aasheesh Verma is involved and detained in
case crime no. 963 of 2008, under Sections 364-A, 332, 353, 307 I.P.C. read
with Section 7 of Criminal Law Amendment Act and Section 3(2) 5 of
S.C./S.T. Act, from Police Station Fatehpur, District Barabanki and he has
applied for short term bail.
The first bail application of the accused applicant was rejected by me.
Learned counsel for the accused applicant contends that the father of the
accused applicant is suffering from unnatural growth on his scalp and his
mother is too suffering from stone problem. The doctor has advised both of
them for operation. It will take not less than two months for operation of his
parents. There is no male member in the family except the accused applicant
to get them operated. Therefore, the accused applicant be released on short
term bail for two months.
Learned A.G.A. opposed the short term bail application.
Considering the submissions of the learned counsel for the accused applicant
and learned A.G.A. as well keeping in view the ailment of the parents of the
accused applicant, without expressing any opinion on the merit of the case,
the accused applicant may be released on short term bail for a period of two
months.
Let the accused applicant Munna @ Aasheesh Verma be released on short
term bail for a period of two months in the aforesaid case crime number on his
executing a personal bond with two sureties each in the like amount to the
satisfaction of the court concerned.
The accused applicant will surrender before the court concerned just after
expiry of two months from the date of his release.
