After arguing for some time, counsel for the petitioner
contends that he may be allowed to withdraw the present petition in
order to raise all arguments available to him before the trial Court at
appropriate stage. Counsel for the petitioner further submits that since
the cheque on basis of which complaint was instituted was drawn in the
year 1999, his personal appearance before the trial Court maybe
exempted.
The petitioner is in corridors of the Court for the last more
than nine years. Therefore, it will be just and appropriate in case his
personal appearance is exempted before the trial Court. He shall also
furnish an undertaking that he shall cause appearance as and when

required and the evidence recorded in his absence but in the presence
of his counsel shall be binding upon him. Trial Court may also specify
any other condition in the undertaking to be furnished by the petitioner.
On the furnishing of undertaking, the personal appearance of petitioner
shall stand exempted.
The present petition is dismissed as withdrawn with liberty as
prayed for.
