                       J U D G M E N T

Petitioners were employees of the Board and had

retired on superannuation. They are aggrieved by the

non-disbursal of the entire amount due to them by way of

gratuity. They had approached the Controlling Authority

under the Payment of Gratuity and orders were passed

determining the amount due to them. But they have not

been paid the amount due to them by the Board so far

and hence the writ petition.

2. Learned standing counsel for the Board

submits that principal amount due to the petitioners

have been deposited before the Regional Joint Labour

Commissioner and undertakes to see that the amounts

due to them by way of interest are also paid within next

two months. Submission is recorded.

In the result, the writ petition is disposed of

directing the 2nd respondent to see that the balance

amount due to the petitioners by way of interest in terms of

the orders passed in their behalf by the controlling

authority are either deposited before the controlling

authority or paid to the petitioners within two months from

the date of receipt of a copy of this judgment. Obviously,

the amount already deposited before the Regional Joint

Labour Commissioner shall be disbursed to the petitioners

by the said authority on production of this judgment.
