                                JUDGMENT

The learned counsel for the petitioner has filed a memo to

the following effect:

“The above writ petition is filed seeking a declaration that
petitioner is entitled to be considered as an employee who
exercised option to become a member of the Fund
constituted under the State Bank of Travancore (Employees)
Pension Regulations 1995. The above writ petition was
admitted on 11.02.2008 and by an interim order the 3rd
respondent was directed to disburse the employees
contribution due to the petitioner. Now the 1st respondent by
Circular No.21/10 dated 17.09.2010 extended another option
for pension in lieu of contributory Provident Fund to the non-
optees, who were in service prior to 26.03.1996. However,
the bank insists the withdrawal of the above writ petition as
a precondition for accepting the option. In view of the above
writ petition may be permitted to be withdrawn.”

In view of the same, the writ petition is dismissed as

withdrawn.
