                          J U D G M E N T

In the matter of priority for disbursement of retiral

benefits to the retirees from the Kerala State Road Transport

Corporation, a scheme has been evolved pursuant to a

direction in Writ Appeal No. 289/2001. A deviation from such

a direction is possible only in exceptional circumstances. The

contention of the petitioner is that he had underwent cardiac

surgery at Sree Chitra Tirunal Institute for Medical Science

and Technology. Ext.P5 would reveal that treatment expense

would come to Rs. 2,57,597/- and he had borrowed money

from a private financier and paid Rs. 2,10,000/- to the

hospital. Petitioner contends that an amount of Rs.47,597/- is

still remaining to be paid to the said hospital. That apart, he

has to discharge the aforesaid debt. It is in the said

circumstances that the petitioner claims for an out of turn

disbursement of the retiral benefits. In the said circumstances,

the respondents shall enquire into the genuineness of the

claims and contentions of the petitioner mentioned above

within a period of two weeks and if they are ultimately found

genuine, the respondents shall disburse the DCRG and other

retiral benefits payable to the petitioner, expeditiously, at any

rate, within one month thereafter.

Disposed of accordingly.
