19. 20.01.2011 Counsel for the State AAG-1 states that prayer made in the

writ petition has become infructuous in view of the instructions of the

State Government contained in letter dated 22.12.2009, whereunder

the amount transferred to Narkatiaganj and eight other municipalities

has been directed to be returned to the State Government Agency i.e.

BUDA.

Let counsel for the State place on record the letter dated

22.12.2009 of the State Government by filing supplementary counter

affidavit, copy whereof be served on the counsel for the petitioners by

tomorrow(21.01.2011) so as to enable them to file reply, if any.

Put up on 24.01.2011 maintaining its position in the same

list.
