02. 09.12.2010 The petitioner has sought quashing of the order

dated 09.03.2009 passed by Chief Judicial Magistrate,

Gaya in Paraiya P.S. Case No. 96 of 2007 by which he has

taken cognizance under Sections 364 and 302 IPC and

other allied Sections.

Considering that the petitioner is named in the

First Information Report and there was enough material

for taking cognizance in the matter, I am not inclined to

interfere in the matter. The application is dismissed.
