2 09/07/2008 Heard learned counsel for the petitioner and learned counsel

representing the State.

According to the informant, his father and elder brother sold

one plot No. 6393 but in second page of the deed the accused added

one more plot 3554. Accordingly, the possession was declared by the

State Bank.

Submission is that no case of forger is made out. The

matter has been reported after a long lapse of time and the delay has

remained totally unexplained. Further submission is that this is a

matter of title suit and no criminal liability can be fastened.

Considering the facts and circumstances of the case, the

petitioner Nagina Gope is directed to be released on bail on

furnishing of bail bonds of Rs. 10,000/- (ten thousand) with two

sureties of the like amount each to the satisfaction of Sri M. K. Roy, J.

M. Ist Class, Nalanda at Biharsharif in connection with Rahui P.S.

Case No. 209 of 2007.
