1.0 Learned
Additional Public Prosecutor Mr. Pandya places on record the
Statement of the convict dated 11th April 2011, wherein,
he has stated that his elder sister, residing at Navsari, is ready to
bear the expenses for his medical treatment. The communication dated
29th March 2011 from the Medical Officer, Vadodara Central
Jail to the Superintendent, Vadodara Central Jail reads as under:
“He was diagnosed having Planter Keratoderma with multiple
calosity for which he was advised symptomatically but no significant
improvement was noticed even after long period of treatment.
Finally, on 28/10/10 doctors from SSGH has opined that the patient is
resistant to medical treatment. Even Plastic Surgeons opinion for
wearing Soft Rubber Chappals, Warm Water Fomentation and application
of oil did not help much.” (emphasis supplied)
2.0 It
is deemed fit that the applicant – convict be granted Temporary
Bail so as to enable him to take treatment in a private hospital.
3.0 The
application is allowed. The applicant – convict is ordered to be
released on Temporary Bail for a period of 30 days from
the date of his release, on his executing a personal bond of
Rs.5,000/- (Rupees Five Thousand only) to the satisfaction of the
jail authorities.
3.1 The
applicant shall surrender to the jail authorities on expiry of the
Temporary Bail period.
3.2 Rule
is made absolute.
