Heard learned counsel for the applicant and learned A.G.A. appearing
for the State.
It is contended by the learned counsel for the applicant that co-
accused Sintu @ Kishanveer has been allowed bail and the case of
the present applicant is on the same footings.
The factual position is not disputed by the learned AGA. There is last
seen evidence against the applicant.
Perused the bail order of the co-accused. The case of the present
applicant is on the same footings. The applicant is in Jail since 31.8 .
2009.
Considering the facts and circumstances of the case and submissions
made by the learned counsel for the applicant and without expressing
any opinion on the merits of the case, the applicant is entitled to be
released on bail.
Let the applicant Nand Kishore alias Nodiya involved in Case Crime
No. 70 of 2009 under Sections 302, 201 IPC Police Station Sirsaganj,
District Firozabad be released on bail on his furnishing a personal
bond with two sureties each in the like amount to the satisfaction of the
court concerned.
