List has been revised. Nobod is present for the appellant.
Due to the death of Sri V. C. Katiyar, counsel of the appellant, notices were
issued to the appellants to engage another counsel vide order dated
30.06.2009. In compliance of that order, report has been submitted by the
CJM, Fatehpur that the appellant no. 2 Chhedu and appellant no. 4 Subey Dar
have died.
Therefore, the appeal stands abated against the appellants no. 2 and 4, due to
their death.
Notices have been served sufficiently on the appellants no. 1 and 3, but
neither they have appeared nor they have engaged any counsel.
Therefore, Dr. Abida Syed, Advocate, who is present in Court is appointed
Amicus Curiae for the appellant no. 1 and 3. Office to supply copy of the
paper book to Dr. Abida Syed and list in the week commencing 22.02.2010.
List after two months by which date, the CJM concerned shall submit his
report about service of the notice on the appellant.
