         This is in continuation of this Commissions proceedings dated 8.2.2010. As
scheduled, the matter is heard today dated 12.3.2010. Appellant is present. DDA is
represented by Shri R.P. Garg, Deputy Director(OSB) and Shri Rajan Mehrotra, AO(RL).
It is the submission of Shri Garg that the plot of the appellant falls in South Zone and the
pre determined rate for this area upto 100 sq.yds. is Rs. 17,106/- per sq. mtr. and beyond
100 sq. yds., @ Rs. 37,522/- per sq. mtr. These rates have been calculated for the year
2004-2005. As regards, the plot of Shri Mulak Raj, Shri Garg would submit that the rate
for the year 1999-2000 were @ Rs. 9,022/- per sq. mtr. upto 100 sq. yds. and @
Rs.14,413/- per sq. mtr. beyond 100 sq. yds. When queried as to why the rate of Rs.300/-
was communicated to the appellant, Shri Garg would submit that this was the rate for
conversion charges from lease-hold to free-hold.

2.     The appellant, however, is not satisfied with the clarification given by Shri Garg.
He submits that the plot of land was allotted in 1998 and, therefore, the DDA could not
have charged PDR rates prevailing in 2004-05. To this, Shri Garg would submit that the
allotment was actually made in February, 2007, and, therefore, the prevailing rate of
2004-05 was charged.

3.      Be that as it may, Shri R.P. Garg, Deputy Director, DDA, is hereby directed to
communicate this in writing under his seal and signatures to the appellant with a copy
thereof to the Commission in 03 weeks time.

4.      The matter stands closed at the Commission's end.
