ORDER

In
response to the notice, the respondent No.1 has filed affidavit. The
respondent No.1 has, in his said affidavit dated 23.7.2008, stated
that the office of respondent No.1 has issued summons to the
respondents No.2 and 3 intimating that if the payment is not made
then auction process will be commenced. It is also mentioned that the
process of recovery of dues by way of land revenue takes about 2 to 3
months time and therefore, the respondent No.1 needs about 3 months
time to complete the process of auction and recovery. Mr. Mehta for
the petitioner is agreeable with the said request for 3 months time
by respondent No.1. He submitted that the petition may be disposed
off with appropriate direction to the respondents in view of the
affidavit made by the respondent No.1.

So
far as respondent No.2 is concerned, the cause list shows that the
notice by the court has been refused.

In
view of the aforesaid submissions by the learned counsel of the
respective parties, the respondent No.1 is directed to complete the
process of recovery of amount in question by way of land revenue by
following necessary procedure in accordance with law on or before
24th October, 2008.

With
the aforesaid observation and direction, present petition is disposed
off. Notice discharged. Ad-interim relief, if any, granted earlier
stands vacated forthwith. It would be open for the petitioner to
approach this court in case of difficulty.
